Insurance accident question

HELP!!!!!!!!!!! The ins lady called this am. The claims one. I told her *MY* side and she said that since he hit hte culvert it sounds like it's HIS fault. I asked her if that depended ont he police report and I never got a straight answer (my nerves were setting in--I am just about SHOT over this ridiculous thing !I keep telling myself that in 20 years I WON"T EVEN REMEMBEr and that ti's not worth, but well.......). Isn't that true? Doesn't the policeman have to state in his report that he hit the culvert? Cuz that's what caused the trailer ot hit my van? I don't know. I'm not getting my hopes up. The report is to be done Monday and they are taking care of all of it. They'll call me and tell me what was decided. I just wish I knew more aobut how this stuff worked. For some reason I thought the POLICE decided who was at fault and he said the ins companies work it out.

Hi Dana...I'm coming in late but when police get involved in an accident...they write up the report, ticket the (ir) responsible party/parties and *then* the insurance companies get involved.

If the accident is the fault of the other driver, your insurance company will talk with his/her insurance company and settle the claim.

No one was ticketed so I guess that's why I'm not very optimistic that we'll get anything.:(
