• Jan. 6, 2006 - Excited about Chickens

Ok,  So I reread my city ordinances today and I think I can have chickens.  When I read them them the first time, I thought it meant I couldnt  because poultry was not defined as an animal.  But then it gives rules for keeping fowl   Here are what the ordinances say, let me know if what you think!:

"102. Definitions-

ANIMAL – any animal or bird maintained as a domestic pet including, but not limited to, dogs, cats, rabbits, hamsters and birds.  Â“Animal” shall not include livestock or poultry being aised upon working farm(s) and shall not include horses which are not a method of transportation or power for the occupants of a dwelling.

Part 2

Keeping of certain animals

201 Keeping of Pigs Prohibited  No person or persons, partnership, firm or corporation shall keep any pig or hot at any place within the limits of the Borough. (Ord. 1517. 5/13/1985)

202 Prohibited Animals.  It shall be unlawful to keep any wild animals (such as, but not limited to fox, bear, monkeys, raccoons, opposums or skunks) in the Borough of Pottswon (Ord. 1517 5/13/1985)

203. Creation of Unnecessary odor.  No person owning or having in his custody animals or fowl shall so maintain said animals or fowl in such a manner as to creat any obnoxious or foul odor there from beyond the property line (Ord. 1517  5/13/1985)

204 Shelter Standards.  Any person owning or having in his custody animals or fowl on a tract of land less than one-half (1/2) acre shall meet the following standards:

A.  Animals and fowl shall be provided with a shelter having a roof and at least three (3) enclosed sides, and be contained within a fenced area with:

(3) Three (3Â’2) square feet of shelter area for each fowl

Yep, sounds like you can have chickens. I would think that "working farm" codes would come under agriculture, and not applicable to a "residence". If I'm reading your town right, I'm a bit north of you, and I had chickens until a couple of months ago when a fox got them.
I just happened upon your blog, coming to see what all was going on over here. I think I'll have to register!

We are looking into this also, but our county is so rural it is fine, BUT we picked a neighborhood with a covenant, it is LOOSELY followed, so much so that you would never know our neighborhood had one.
Here is what ours says:
"No animals shall be kept or maintained on any lot other than the usual household pets, which shall be so kept and maintained as not to become an unreasonable annoyance or nuisance to other residents."

We have been researching this idea in the suburbs, too. I look forward to seeing what you guys are doing in this. Thanks so much for stopping by my blog and commenting, too. I really appreciate your encouragement and will be praying as you consider bread baking. I had to save money to buy supplies over a period of time but I had the support of my husband on it all the way. That is very important so I will pray for that for you, too. Blessings!!!
