Do You Buy or Sell Pre-owned Clothes and Toys for your kids???? As of FEB. 10 2009 you will not be able to ANYMORE!
In August of 2008, important legislation passed that was intended to protect children from harmful lead in toys, equipment and clothing. Although the intention is good, the bill that was passed is poorly written. Thus, it will prohibit the resale of ANY used clothing, toys, equipment for children unless you can PROVE it is lead free. This means that stores such as Goodwill, Salvation Army, Kid to Kid, Once Upon a Child, any thrift store, all children's consignment sales, Ebay sales, Craigslist and GARAGE SALES are prohibited from selling children's clothing, toys or equipment after FEB. 10, 2009 unless they have had the item tested for lead and can provide verification that it is lead free.
This is SO detrimental to young families who depend on buying used clothing at consignment sales or thrift stores. This is also a problem for middle income families who sell their children's outgrown clothing at garage sales, consignment stores or ebay to provide the funds for the next season of clothing. Also, take into consideration what this will do to our landfills!!!! Can you imagine everyone throwing their toys away because the government says you are not allowed to sell them??? That's crazy! Anyway, below is a link to a news story in the LA Times regarding this new law that will take effect on February 10, 2009. Also, there is a BOLD HIGHLIGHTED link to a form you can fill out (takes less than 1 minute) and it will automatically send it to your state representatives regarding rewriting this legislation.

I think what some people are missing is that there is soap in the world, use it. Our landfills are going to be so full of stuff that can be used by people. What a waste. Buying used is not a crime nor is it gross. What is going to happen to all of these organizations who help support things like , cancer, shelters, homeless,people in need. They have thrift stores to help them help others.

The thing that gets me about this is that the problem is not from homemade items and probably not even older stuff. It is from these stupid people who want to harm children. Any way, sorry to rant but it really gets me.

I think its a great idea. I think buying used clothes and toys is nasty and cheap. Do you know everyone single person who get them from. You have no idea what kind people sell this stuff. Do they smoke live on a farm with dirt and animals? Why not just buy stuff at the store that is lead free and made in America? Look for sales and buy it then,

Since the economy has gone sour and so many families are having a hard time making ends meet it seems ridiculous to pass a law like this. While the intentions were good this law will end up hurting more families in the long run. What about families like "The Duggars" who purchase almost all their clothing used at thrift stores?
As to "anonymous" - just because something is sold in a store does not mean it was made in America, it is cheaper for clothing companies to have their items made elsewhere and shipped here to be sold under the companies logo. Also, your dumb comment about the used clothing being from a farm family...I suppose you don't like to eat??? It's the farmers that are the backbone of this country and always have been! And one more thing...have you ever heard of the four letter word "SOAP"...as in laundry soap? Most parents I know will buy used at garage sales or thrift stores and come home to wash the items before letting their children wear them. Just good ol' common sense which by your comments shows us is something that you are clearly lacking!!! Enough said!!!

Thanks for the information. I just filled out the form. This is so scary. 95% of my children's clothes come from the thrift store. And anything I could buy "new" at the store can't even come near the price I pay for used clothes. More than not, the clothes I find are in brand new condition and some even still have tags on them. And apparently your anonymous commenter doesn't know what soap is. And also doesn't care what this is going to do to our earth with everything that will be considered "hazardous waste" being thrown to the landfills since it won't be able to be sold. Lord willing, there will be something done about this. Otherwise, there will have to be some kind of free exchange program put in place for parents who can't afford new clothes.

This is for the person who thinks that buying used kids items is nasty. My 1st question is, "Where did you go to school?" They must not have taught grammar, because you sure can't speak well.
2nd you have the nerve to say that we "farm people" are dirty. That's odd considering I own and run a cleaning service. Do you eat beef, pork or chicken? What about vegetables? Bread, cereal, milk? Do you even eat? Well I hate to break it to you honey, but all those things come from "US DIRTY FARMERS." We are responsible for keeping you from starving.
My bet is that you probably don't have a pot to piss in or a window to throw it out of.
If you can't say anything nice, don't say anything at all. I'll see ya at the Goodwill Store. lol

I read the act that was passed and I can't seem to find where it's illegal to buy used clothing. It's stating the import regulations on new clothing and toys for children 12 and under. This is talking about new items that are being made and existing new items on the shelves for testing. I couldn't find at all in the act about it affecting consignment stores and thrift stores. They are making it easier for recall notices I've read so for those who own consignment stores like my brother, his wife and three children.. can easily know what items they can take and what items they can't.. That's just what I read.. :)

If these items are truly going to be labled "hazardous waste".....then forget about disposing of them in the landfill. Hazardous waste isn't allowed to be just put willy nilly into the landfills (at least in the 3 states I've lived in). They require special handling (read special fees) and are handled differently. Think tires, old paint, solvents, refrigerators (because of the coolant).
I can see it now.....people unable to afford to legally dispose of their children's outgrown clothing because they can't afford the hazardous waste fees.....so they stockpile the stuff in their garage.....and then in the utility room....and then it invades the laundry room....and as the kids reach middle school age they must sleep in the living room because their old clothing and toys have taken over the bedrooms (and of course we can't store it in the living room, what would the neighbors think....oh wait, the neighbors have more kids than I do, so they are worse off!).
While I agree that this law needs to get tweaked to say what it actually means......please don't go into a panic about it. Write to your representatives and let them know they need to fix it.....but so many laws start out with poorly worded, or poorly thought out, language and get fixed. A big part of the problem is that no one in Washington has probably ever had to purchased used anything......so they don't really understand the consequences of the laws they're making because they are so out of touch with the "real" people of this country.
Ok, off to tell my rep that there is another one for them to fix.......and then off to read the ENTIRE law to see what kind of "pork" was added to it.....you know that somewhere someone is getting a kick back on this.

Guess we will all have to become criminals and go underground in order to survive. Can you imagine resale shops hidden and being raided or used books being hidden and sold. Once again Big Brother thinks they know what is best for us when common sense should prevail- go catch the guys manufacturing lead products(i.e. China ) and quit trying to over regulate our economy. Do they really think we are so dumb as to buy something dangerous for our children.And I see no advantage to books and clothing falling into this category at all.Do we eat our books and clothes? And I know how to read recalls of products to advoid toys and items that are unsafe.As for that guy who thinks resale is too good for him , grow up but keep paying retail just make sure you donate all those items instead of adding to our country"s landfill problems.Plus buy some soap and try washing your clothes instead of throwing them out after you wear them!!!
Enough on that. It is people like that who wrote this bill : people who lack COMMON SENSE! Thanks for letting me rant .Now go contact your congressmen so they can fix it before it goes into effect and YES they can retroactively rewrite this or get rid of it altogether.

I can't believe that that person had the nerve to say (in their horrible grammar) that resale items are nasty and cheap. Plus, as mentioned, completely ignorant to believe that all of the items in stores are American! LOL Have you read a clothing lable lately? And chances are, if the clothing is made in the U.S., its not going to be cheap in price anyway, because labor costs are so much higher here. Get real, and know your facts before going off.

Please tell me this is not true. Okay I don't want lead in my child's toys ect. When has there been lead found in clothing? I don't have T.V. so maybe I missed something. I love used items and much of the time that old item lasts longer and is better made then that new thing in the store.
I'm hearing all this talk about landfills, now we call them transfer stations because we ship our trash over seas so that china can melt it down for toys or what ever it is they make it into.
My grandma told me more laws just make more outlaws this proves her right. And my dad told me common sence isn't so common well the one without soap proves this. Now it's time for some action. Thank you to everyone who is doing their part.

I am just curious if this goes for Canada too? I live in Canada and am a low income family. If this happens here as well, it will be a disaster. Also, so many charities rely on these sales for their organizations. Just because politicians can afford and go out to buy brand new items for their children, doesn't mean everyone can. Maybe they should try to live off of what we earn. This is so unfair for everyone.

This is ridiculous! Lawmakers need to re-write the law in detail so it really works as is was intended. There is nothing wrong with most used items. Besides, most of the lead in the news recently, was in NEW toys made in China!
